Yesterday, the European Commission opened two sets of specification proceedings to assist Google in meeting its obligations under the Digital Markets Act (DMA). These proceedings formalize the Commission’s regulatory dialogue with Google on key compliance areas.
The first set concerns Google’s duty under Article 6(7) of the DMA to provide third-party developers with free and effective interoperability with hardware and software features controlled by Android. This round focuses on features used by Google’s own AI services, such as Gemini, and aims to ensure third-party AI providers have equal access, fostering innovation and competition in mobile AI services.
The second set relates to Google’s obligations under Article 6(11) to give third-party online search providers access to anonymised ranking, query, click, and view data from Google Search on fair, reasonable, and non-discriminatory (FRAND) terms. The proceedings will clarify the scope of data, anonymization methods, access conditions, and eligibility for AI chatbot providers. Access to this data is intended to enable competitors to improve their search services and provide genuine alternatives to Google Search.
The Commission plans to conclude the proceedings within six months, sharing preliminary findings within three months. Summaries of these findings and proposed measures will be published for third-party comments.
The proceedings do not determine compliance and do not limit the Commission’s powers to later impose fines or penalties if Google is found in breach of the DMA.
