The European Commission is seeking public feedback on commitments proposed by Sanofi to address concerns that it may have unfairly undermined its rival flu vaccine, Fluad, through misleading communications to healthcare professionals in Germany and France.

The Commission’s preliminary investigation found that Sanofi, which markets the enhanced flu vaccine Efluelda, may hold a dominant market position and may have misrepresented scientific evidence and national vaccination recommendations since 2024, potentially violating EU competition rules (Article 102 TFEU).

To address these concerns, Sanofi has proposed to:

  • Publish statements on its German and French websites clarifying that national health authorities consider Efluelda and Fluad equally recommended for older adults.

  • Include Germany’s official vaccination recommendation in promotional materials for four years.

  • Stop making claims that question national vaccine recommendations or suggest that Efluelda is safer or more effective than Fluad unless supported by approved product information or robust comparative studies.

  • Avoid portraying Fluad as having weaker scientific evidence and ensure these commitments also apply to communications by contracted Key Opinion Leaders.

The commitments would remain in force until March 2030, with compliance monitored by an independent trustee.

The European Commission has invited interested parties to submit comments on the proposed commitments by 21 August 2026.
